Terms of Service

Welcome to PolarLabs. These Terms of Service (“Terms”) govern your access to and use of polarlabs.shop (the “Site”) and any purchase of products from PolarLabs LLC (“PolarLabs,” “we,” “us,” or “our”). By accessing the Site, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree, do not use the Site.

Eligibility

You must be at least 21 years old to access the Site or purchase products. By using the Site, you represent that you are at least 21 years old, that you have the legal capacity to enter into these Terms, and that you are purchasing products solely for lawful laboratory research use.

Products and Intended Use

All products sold by PolarLabs are intended solely for lawful laboratory research use. Products are not for human use, veterinary use, consumption, injection, administration, diagnostic use, therapeutic use, or disease-related use of any kind. No content on the Site constitutes medical advice, clinical guidance, dosing guidance, or a recommendation for human or animal use. See our Research Use Only Disclaimer for full detail.

Regulatory Status

PolarLabs LLC is not a licensed pharmacy, compounding pharmacy, or chemical compounding facility as defined under Section 503A of the Federal Food, Drug, and Cosmetic Act, and is not a registered outsourcing facility as defined under Section 503B of that Act. PolarLabs does not compound, dispense, or prepare products for administration to any individual patient, and does not accept prescriptions. All products are sold exclusively as research chemicals for laboratory use, in a form and under conditions not intended or suitable for human or animal administration. Statements regarding our products have not been evaluated by the FDA, and products are not intended to diagnose, treat, cure, mitigate, or prevent any disease.

Account Registration

You are responsible for maintaining accurate account, payment, shipping, and research-purpose information, and for safeguarding your account credentials. You agree to update your information as needed and are responsible for all activity under your account.

Orders

PolarLabs may reject, cancel, limit, or request verification for any order due to suspected fraud, misuse, inaccurate information, prohibited shipping destinations, inventory issues, pricing errors, or other legal or compliance concerns, at our sole discretion. Prices are subject to change without notice. All orders are subject to acceptance and product availability.

Resale and Marketing Restrictions

You may not resell, redistribute, relabel, or market PolarLabs products without prior written authorization from PolarLabs.

Prohibited Claims and Conduct

You may not make, publish, or imply any medical, human-use, dosing, purity, testing, shipping, or other unsupported claim about PolarLabs or its products. You may not use the Site for any unlawful purpose, misrepresent your identity or research purpose, interfere with Site operation, attempt unauthorized access, or use automated tools to scrape or access the Site.

Zero-Tolerance Communication Policy

PolarLabs maintains a zero-tolerance policy regarding any communication — through customer support, product reviews, social media, affiliate content, or any other channel — that requests, discusses, or provides advice on the reconstitution, dosing, administration, or bodily introduction of any PolarLabs product into a human or animal. PolarLabs does not provide reconstitution or dosing instructions under any circumstances. Any such communication, whether initiated by a customer, affiliate, or PolarLabs staff, will result in immediate order cancellation and account termination at PolarLabs’ sole discretion, without refund.

Termination

PolarLabs may suspend or terminate your account or refuse service at any time, for any reason, at our sole discretion, including for suspected misuse of products or violation of these Terms.

Intellectual Property

All Site content — including text, graphics, logos, and product imagery — is the property of PolarLabs or its licensors and may not be reproduced or used without written permission.

Assumption of Risk

YOUR PURCHASE, POSSESSION, HANDLING, STORAGE, AND USE OF ANY POLARLABS PRODUCT IS AT YOUR SOLE RISK. YOU ASSUME ALL RISK ARISING FROM IMPROPER STORAGE, HANDLING, MISUSE, OR ANY APPLICATION OF A PRODUCT TO A HUMAN OR ANIMAL, AND YOU WAIVE ANY CLAIM AGAINST POLARLABS ARISING FROM SUCH USE OR MISUSE TO THE FULLEST EXTENT PERMITTED BY LAW.

Disclaimer of Warranties

THE SITE AND ALL PRODUCTS ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, EXCEPT AS EXPRESSLY REQUIRED BY APPLICABLE LAW. A CERTIFICATE OF ANALYSIS, WHERE PROVIDED, REFLECTS TESTING AT THE TIME OF ANALYSIS ONLY AND IS NOT A WARRANTY OF FITNESS FOR ANY APPLICATION.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POLARLABS AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE SITE OR PRODUCTS. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.

Indemnification

You agree to indemnify, defend, and hold harmless PolarLabs and its owners, officers, employees, and agents from any claims, damages, or costs (including reasonable attorneys’ fees) arising from: your use or misuse of products, including any application to a human or animal; any claims or representations you make about PolarLabs products (including as an affiliate); or your violation of these Terms or applicable law. This obligation survives termination of your account.

Dispute Resolution — Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Site, or any product purchased from PolarLabs shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, conducted by a single arbitrator in Fulton County, Georgia.

Class Action Waiver. You agree that arbitration will be conducted only on an individual basis, not as a class, consolidated, or representative action. You waive any right to participate in a class action or class-wide arbitration against PolarLabs.

Small Claims Exception. Either party may bring an individual action in small claims court within that court’s jurisdictional limits.

You accept these Terms, including this arbitration provision and the class-action waiver, by agreeing to the Terms of Service at checkout and by accessing the Site or placing an order. By doing so, you waive your right to a jury trial and to participate in a class action, as described above.

Governing Law and Venue

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Any permitted legal proceeding shall be brought exclusively in the state or federal courts located in Fulton County, Georgia, and you consent to the personal jurisdiction of such courts.

Changes to Terms

We may modify these Terms at any time. Continued use of the Site after changes constitutes acceptance. Material changes to arbitration or liability terms should be flagged with a re-consent prompt rather than a silent update.

Severability & Entire Agreement

If any provision is found unenforceable, the remaining provisions remain in effect. These Terms, together with our Privacy Policy, Research Use Only Disclaimer, Refund Policy, and Shipping & Returns Policy, constitute the entire agreement between you and PolarLabs.
